NON-ATTAINMENT AREA FOR SWEETWATER COUNTY. The Council earlier adopted the provisions of Section 25 of the Wyoming Air Quality Standards and Regulation in order to impose enforceable requirements for the installation of control technology at specified facilities. This additional control technology was believed to be necessary in order to bring the ambient concentrations of particulate matter into compliance with the applicable standards.  At the hearing FMC Corporation made a showing through the use of monitoring data and analytical techniques that the standards have been achieved and that certain additional control technology requirements  are not necessary to assure the maintenance of the standards.

AMBIENT AIR QUALITY STANDARD FOR LEAD, AND REVISION OF RULES RELATING TO BACT AND NEW SOURCE PERFORMANCE STANDARDS.   This rulemaking was initiated for the following major purposes:  1)  to adopt an Ambient Air Quality Standard for Lead;  2)  to revise the existing regulations pertaining to New Source Performance Standards;  and 3)  to revise the existing provisions pertaining to Best Available Control Technology for large mining operations.

ADOPTION OF AN IMPLEMENTATION PLAN AND REGULATIONS FOR VISIBILITY PROTECTION. Adopting an Implementation Plan Providing A strategy for the evaluation of visibility in any mandatory Class I federal area and the adoption of revisions to the regulations relating to Prevention of Significant Deterioration to provide for notification to federal land managers of permit applications which might potentially affect such mandatory Class I areas.

ADOPTION OF REVISIONS TO THE IMPLEMENTATION PLAN RELATING TO HYDROCARBONS AND THE REVISION OF REGULATIONS RELATING TO THE EMISSIONS OF SULFUR DIOXIDE. Revising the Implementation Plan and Rules and Regulations of the State by eliminating an ambient air quality standard for hydrocarbon and for the purpose of revising the sulfur dioxide emission regulations applicable to fuel burning equipment.

ADOPTION OF REGULATIONS RELATING TO THE EXPIRATION OF A CLEAN AIR RESOURCE ALLOCATION. In response to a concern expressed by the Legislative Management Council staff that the rules were not filed within 60 days of adoption.  The EQC readopted on the regulations on Clean Air Resource Allocation Expiration.

Section 11 CHEVRON CHEMICAL COMPANY’S PROPOSED REVISIONS TO THE FLUORIDE STANDARDS. Revising the regulation for fluoride appearing in Section 11 of the Wyoming Air Quality Standards and Regulations. To protect the sensitive vegetation species and foraging animals, standards for concentrations of fluoride in the ambient air are necessary.

Section 3, Ambient Air standards for Particulate Matter. Adoption of regulation defining "Ambient Air" will resolve permit and air right disputes and allow the flexibility needed to continue development to meet current and future markets..

Section 28 IMPLEMENTATION PLAN FOR VISIBILITY The EPA incorporated Federal plans into Wyoming's SIP and had certain authority for enforcing and implementing such plans in Wyoming's Air Quality Program.  Adoption of the these regulation and SIP for visibility protection in Class I areas allowed Wyoming to regain control of its Air Quality Program.

Section 29 EMISSION STANDARDS OF ASBESTOS  This regulation wan enacted to protect the public form exposure to asbestos fibers from demolition and renovation of institutional, commercial, or industrial buildings containing asbestos materials and from the spray application of asbestos-containing materials.

SECTION 21, REVISIONS TO STACK HEIGHT REGULATIONS The EPA regulation regarding stack heights was promulgated in 1985 requiring States to update or put in place regulations which would satisfy Federal regulations.  These revisions are necessary in order to retain control of the air quality new source permit program.

SECTION 22, NEW SOURCE PERFORMANCE STANDARDS  Wyoming has periodically adopted new or revised New Source Performance Standards as part of its Air Quality Standards and Regulations in order that EPA may delegate its authority for implementation and enforcement of new standards and revisions to the State as they become available.  These revisions and additions to Section 22 of the Air Quality Standards and Regulations will bring the State current with the Federal NSPS as of July, 1986.

PM10 STANDARDS and the RETENTION OF THE STATE’S CURRENT 24 HOUR TSP PARTICULATE STANDARD.

The Environmental Quality Council adopted "PM10" (Particulate Matter with an aerodynamic diameter less than or equal to a nominal 10 microns) ambient particulate standards as Wyoming's primary health related standard.  In addition, the Council voted to retain Wyoming's current 24 hour "Total Suspended Particulate" standard as the State's secondary welfare related standard.

SECTION 30 (OPERATING PERMITS); SECTION 33 (NATIONAL EMISSION STANDARDS FOR HAZARDOUS AIR POLLUTANTS (NESHAPS), SECTION 34 (ACID RAIN PROGRAM) - Hearing held June 23, 1997.  Statement of Principal Reasons for Adoption was signed by John Morris on June 23, 1997.

SECTIONS 2, 4, 5, 8, 9, 10, 16, 21, 22, 24, 26, 29, 33, 34, AND THE ADDITION OF SECTION 107, REDESIGNATION: A hearing was held August 24 & 25, 1998 regarding the proposed establishment of two additional PSD "baseline areas" within the Powder River Basin Attainment Area. These "baseline areas" are to be equal in size respectively to the projected significant annual average particulate matter impact from the ENCOAL and Two Elks projects which are proposed to be located in the region. The Statement of Principal Reasons for Adoption was signed on August 24, 1998 by Steve Youngbauer.

REVISIONS TO SECTION 35 (MUNICIPAL SOLID WASTE LANDFILLS); SECTION 30 (INCORPORATE); SECTION 22(b); SECTION 37 (HOSPITAL/MEDICAL/INFECTIOUS WASTE INCINERATORS. DOCKET NO 99-2100: Section 35 is being revised to incorporate Section 30 Operating Permits applicability to existing municipal waste landfills. These revisions are not new requirements but clarification of existing requirements. Section 35 is further revised to further clarify that all citations of the federal rule on landfills are references to the rule as incorporated by reference through Section 22(b) New Source Performance Standards. Section 37 is a new section. The regulation contains emission limits and compliance requirements for controlling certain designated pollutants from existing hospital/medical/infectious waste incinerators. The hearing was held April 8, 1999 in Lander. Den Costantino signed the Statement of Principal Reasons for Adoption on April 9, 1999. Two tapes are in the file.

REVISIONS TO SECTIONS 1 - 37 OF CHAPTER 1: The Council held a hearing on September 13, 1999 in Jackson, WY. The Council adopted the revisions to Sections 1 - 37 of Chapter 1. The revisions involved restructuring of Chapter 1 into 13 chapters to create sensible document organized by subject matter and will allow for organized growth. The Statement of Principal Reasons for Adoption was signed on September 13, 1999 by Den Costantino.

CHAPTER 1, SECTION 3; CHAPTER 2, SECTION 2;CHAPTER 3, SECTION 2; CHAPTER 6, SECTION 2; PROPOSE TO MODIFY PERMIT CONDITIONS IN PERMITS ISSUED TO SOURCES AROUND THE STATE WHICH OPERATE COAL TRUCK DUMPS, DOCKET NO. 99-2102: A hearing was held February 17, 2000. Chapter 1 is being revised to add definitions. Chapter 2 is changing to incorporate ambient standards for PM2.5 w/c the division must adopt to meet the requirements of the EQA. The division is also proposing to remove the TSP standard as it is no longer a federal standard. Chapter 3, the division is also proposing to modify this to clarify the applicability of the opacity standard. Chapter 6 is being revised to remove a significance level for TSP. The Statement of Principal Reasons for Adoption was signed February 18, 2000 by Nick Bettas.

CHAPTER 1, COMMON PROVISIONS, SEC. 6(NEW), CREDIBLE EVIDENCE; CHAPTER 3, GEN. EMISSION STANDARDS, SEC. 6, EMISSION STANDARDS FOR VOCs; CHAPTER 5, NATIONAL EMISSION STANDARDS, SEC. 2, NEW SOURCE PERFORMANCE STANDARDS; CHAPTER 6, PERMITTING REQUIREMENTS, SEC. 3, OPERATING PERMITS; CHAPTER 7, MONITORING REGULATIONS, SEC. 3 (NEW), COMPLIANCE ASSURANCE MONITORING; CHAPTER 11, NATIONAL ACID RAIN PROGRAM. A hearing was held September 11, 2000 in Jackson, WY. The Council adopted the additions and revisions and corrections to the above. The Statement of Principal Reasons for Adoption was signed by Wendy Hutchinson on October 23, 2000.

Revisions to Chapter 1, Sec. 3; Chapter 2, Sections 3,4,5,6; Chapter 3, Sections 2 & 6; Chapter 5, Sections 2 & 3; Chapter 11, Sec. 2, Pkg. 1J Chapter 1 was revised to add definitions and a new list of acronyms to the regulations. Chapter 2 will incorporate a re-instated Federal 1-hour ozone standard into State rule. Chapter 3, Sec. 2 is being modified to remove outdated language relating to opacity readings of steam plumes; Sec. 6 is being changed to incorporate the most recent definition of volatile organic compounds by reference to the CFR. Chapter 5 and 11 are also being modified to incorporate recent changes to the CFR into State rule by reference. A hearing was held on 12-7-01 and the Council adopted the revisions and additions to the chapters. The Statement of Principal Reasons for Adoption was signed on 2-21-02.

Revisions to Chapter 5, Sec. 2 & 3; Chapter 6, Sec. 3; Chapter 7, Sec. 3; Chapter 11, Sec. 2, Docket No. 02-2100:  Chapters 5 and 11 are being revised as part of an annual effort to adopt regulations by reference from the CFR and also to demonstrate consistency with federal rule. Chapters 6 and 7 are in response to a federally mandated change in the definition of "major source" as well as some minor corrections to the numbering system. Chapters 5,6,7 & 11 were brought up for revisions. A hearing was held on 12-12-02. The Statement of Principal Reasons for Adoption was signed on 12-12-02.

CHAPTER 6, SEC. 4, - Docket No. 06-2101  Chapter 6 was modified to incorporate changes to the Prevention of Significant Deterioration (PSD) and Nonattainment New Source Review (NSR) Rule promulgated on December 31, 2002.  It was also modified to address inconsistencies within Federal new source review rules which existed prior to the December 31, 2002 NSR rule changes, in order for the State of Wyoming to retain primacy in the NSR permitting program.  The hearing was held on July 18, 2006 in Casper, WY at the Oil and Gas Conservation Commission Building.  The Standard of Principal Reasons was signed by Richard C. Moore, Hearing Examiner.
