SOLID WASTE - CHAPTERS 1, 2, 3, 6, 7, AND 8. Hearing held on December 5, 1997. Tape recorded by DEQ. The rules were adopted on March 2, 1998 and signed by Wendy Hutchinson. The governor did not sign the rule adoption due to some errors. It therefore prompted a 2nd round of public comment, which ended July 17, 1998. The #2 file was for the 2nd round of public comment. The comments were addressed and a 2nd Statement of Reasons for Adoption was signed by Steve Youngbauer on August 24, 1998.

SOLID WASTE, CHAPTER 2, SECTION 5(d), SANITARY LANDFILL REGULATIONS: There was a proposal for an extension to daily cover requirements for Type II facilities from October 9, 1995 to October 9, 1997. These are facilities that receives less than 20 tons of solid waste per day, and there is no evidence of existing ground water contamination, and receive less than 25 inches of precipitation per year. At the last minute, EPA approved a two-year extension of most Subtitle D requirements for small landfills, This extension allows authorized states like Wyoming to defer imposing the Subtitle D standards at Type II landfills until October 9, 1997. This Subtitle D requirements which can now be delayed for Type II landfills include location restrictions, operating criteria, design criteria, ground water monitoring requirements, and many of the closure and post-closure criteria. The Department believes that delaying the daily cover requirements for small landfills will provide significant financial relief to the landfill operators and provide more time for the public to use the facilities while alternative waste management services are explored. An emergency rule hearing was held November 27, 1995 in Casper, WY. A Statement of Principal Reasons for Adoption was signed November 27, 1995 by Kim Cannon. The Council finds that this regulation is reasonable and necessary to accomplish the policy and purpose of the Act, and that it has been promulgated in accord with the emergency rulemaking provisions of the Wyoming Administrative Procedure Act.
