CHAPTER XVIII, NPDES PERMIT REGULATIONS; and CHAPTER XIV. Hearing held on April 24, 1991. Re: Existing Chapter XIV would require bonding and financial assurance requirements for commercial waste treatment, storage, and disposal facilities used for the management of more than 10 tons of dried wastewater treatment sludges or the equivalent thereto per operating day. Regs would not apply to publicly owned facilities. CHAPTER XVIII is a new rule which would authorize the department to issue single general NPDES permits each of which would regulate similar point source discharges within a specified geographic area.

CHAPTER 1, SECTION 2 AND 7 - Hearing held August 24, 1998 via videoconferencing. Statement of Principal Reason was signed by Steve Youngbauer on August 24, 1998.

CHAPTER 1, APPENDIX B: A public hearing was held via video conference system on March 2, 2000. DEQ proposes to amend and revise Chapter 1. This proposal is limited to a revision of the numeric criteria for arsenic, barium, iron and manganese, and the creation of a new appendix for the listing of site-specific criteria. This proposal only consists of a limited revision to Appendix B and Appendix F of the Chapter 1. Appendix B contains numeric aquatic life and human health values for a wide range of priority and non-priority pollutants which may be found naturally or discharge into waters of the state. Appendix F contains equations for calculating numeric aquatic life values for a number of metals where toxicity is related to water hardness. The Statement of Principal Reasons for Adoption was signed by Steve Williams on March 7, 2000.

CHAPTER 3, Regulations for permit to Construct, Install or Modify Public Water Supplies, Wastewater Facilities, Disposal Systems, Biosolids Management Facilities, Treated Wastewater Reuse Systems and Other Facilities Capable of Causing or Contributing to Pollution (Sections 2, 7, 8, 9, 12, 15, 18): This Chapter will be modified to provide for the issuance of general permits and, in limited cases, permit by rule specified classes of facilities. Those wishing to apply for coverage under a general permit would provide notification to DEQ and information to demonstrate compliance with the general permit requirements. Coverage would begin as soon as an authorized representative of the department issued a state of coverage. The permit by rule allows a limited number of facilities to be constructed in accordance with design standards of the rule and allow not require an approval by the department prior to construction of the facility. The intent of the proposed rule revisions is to simplify and shorten the permitting process for those facilities that can be addressed with a more efficient permitting process for the both the agency and the applicants who can quality for the general permit/permit by rule and should result in no less protection of the water resource. A hearing was held on November 4, 1999. The Statement of Principal Reasons for Adoption was signed on November 5, 1999 by Den Costantino.

CHAPTER 22 - Capacity Development Standards for Public Water Supplies: This rule will establish the Capacity Development demonstration process for new or modified community and nontransient noncommunity water supplies commencing operations on or after October 1, 1999. The adoption of these rules is required in order to comply with the 1996 Safe Drinking Water Act amendments. It is also required by Enrolled Act 57 of the 1998 Wyoming Special Session. The proposed rule exceeds the minimum requirements of the federal statute in order to meet the requirements of the Enrolled Act 57 relating to modified facilities. In Section 1 of the proposed rule refers to the authority of these rules. Section 2 describes severability of any portion(s) and/or sections determined to be invalid. Section 3 refers to the capacity development standards. Section 4 includes definitions relating to capacity development. Section 5 describes the steps public water supplies must take to demonstrate capacity development. This is a key section of the new program as it defines the requirements for capacity development. Section 6 describes the requirements for capacity development implementation. Section 7 describes processing procedures. A hearing was held May 12, 1999. The Statement of Principal Reasons was signed by Den Costantino on July 9, 1999.

CHAPTER 16, UNDERGROUND INJECTION CONTROL (UIC), CLASS V FACILITIES: this rulemaking hearing was held on April 16, 2001 in Cheyenne. Class V injection includes all facilities which emplace fluids into the subsurface which are NOT included in Class 1-IV facilities. Class V facilities include septic systems greater than 2,000 gallons per day, subsurface discharges from hearing and cooling systems, coalbed methane injections of useable water into useable water and others. The changes considered deal with permitting mechanisms for several subclasses of Class V facilities. The Statement of Principal Reasons for Adoption was signed by Wendy Hutchinson on June 21, 2001.

Water Quality, Chapter 1, Wyoming Water Quality Rules and Regulations & Associated Documentation – Triennial Review: Hearing held August 30 & 31, 2000. Chapter 1 contains the water quality standards for all surface waters in the state. Statement of Principal Reasons for Adoption was signed by the Chair, Wendy Hutchinson on June 21, 2001

Chapter 12, Sec. 14(i), Distribution Systems Subsection (i), Cross Connections, Docket No. 02-3101: The WQS submitted a request for a hearing on the above chapter on 11-20-02. DEQ stated that on 11-30-98, the WQD received a petition for rulemaking from the City of Torrington to revise the requirements for residential check valves as required by Chapter 12, Sec.14(i). On 1-16-99, the WQD received a second petition for rulemaking from the Cheyenne Board of Public Utilities to revise requirements for residential check valves as required by Chapter 12, Sec. 14(i). Rule change was needed to effectively implement the basic requirement of preventing backflow of unsafe or potentially unsafe water to the public water supply. This revision of rules is not required by federal law or regulations. A hearing was held on 1-17-03 and the adopted the revised rules to provide improved protection to public health and the safety for public water supplies. The Statement of Reasons for Adoption was signed on 1-17-03.

Chapter 23, Minimum Standards for Subdivision Application, Docket No. 01-3102: On 5-30-01, the Council received a request from DEQ to proceed with final adoption these rules. The proposed rule is intended to establish those standards that the department believes are necessary to ensure that subdivision applications demonstrate the safety and adequacy of the proposed systems pursuant to the statutory requirements. Where practical, the division is relying upon and incorporating into the proposed rule appropriate standards taken from existing regulations. This is especially the case for applicants proposing to connect to existing water or sewer systems, or to develop new ‘central’ water or sewer systems. Where applications propose the use of on-lot sewage systems, conventional septic systems generally, the division is relying upon and incorporating into the proposed rule several standards taken from existing regulations with a few exceptions. Secondly, the proposed rule provides for an evaluation of the potential cumulative effect of nitrate loading from multiple septic systems within the proposed subdivision on downgradient domestic use, or potential domestic use, of an unconfined aquifer. Lastly, the proposed rule acknowledges the findings of several recent studies substantiating that, especially where high transport rates exist, the potential for nitrate and pathogen contamination of drinking water wells from conventional septic systems is greatly increased. This proposed rule will result in a more efficient review process for the both the agency and the applicants, and should result in better protection of the water resources. This new chapter is not required by federal law or regulations. The Statement of Principal Reasons for Adoption was signed on 8-12-02.

Chapter 20, Permitting, Design and Operation Standards fpr Confined Swine Feeding Operations – a Petition from Bard Ranch: Hearings 1-21-97 & 11-10-98 The Council has accepted Bard Ranch petition to consider adopting a new chapter of the Water Quality rules & regs. This new chapter would be Chapter 20 and would contain a definition of the term "Large Concentrated Swine Feeding Operation." The proposed new chapter would impose a one year moratorium on issuance of permits related to large concentrated swine feeding operations. Bard Ranch contends that current laws are insufficient to adequately address the impacts of large concentrated swine operations and the moratorium should be imposed to allow the state legislature opportunity to consider legislation that will address these swine operations. Bard Ranch proposed rule would temporarily halt permitting to allow the legislature and the DEQ to review and revise, as necessary, statutes and regulations regarding large animal feeding operations. The hearing was held 1-21-97 in Cheyenne. This record was incorporated into the record of the emergency rulemaking that was heard on 10-14-96. The Statement of Principal Reasons was signed on 4-9-99.
